Hume City Council has started enforcement proceedings in the Victorian Civil and Administrative Tribunal in relation to ongoing earthworks on land at 370 Riddell Rd. Council alleges some of the activities at the site is in contravention of the Hume Planning Scheme.
The council began investigating the Canterbury Hills site in July following complaints from nearby residents.
A public hearing on the matter is due to be held by Victorian Civil Administrative Council (VCAT)on Wednesday 21 August.
A statement shared by Cllr Trevor Dance reveals that council has applied for an interim enforcement order which will require any ongoing works on the site to cease, and not recommence, until the tribunal has heard and determined the whole of the proceedings.
In addition, council has applied for an enforcement order which would require the owners and occupier of the land to rehabilitate the property “as far as practicable to its condition before the alleged unlawful works commenced”.
“Council recognises that the ongoing works could pose a significant risk to the environment and the community, and it has commenced these proceedings as a means of ensuring that any immediate risk is swiftly and appropriately managed,” states the council.
