Sunbury earthworks dispute heads to VCAT hearing

Sunbury residents can expect a resolution in March 2025 regarding earthworks at 370A and 430 Riddell Rd that are allegedly in violation of the Hume Planning Scheme.

Hume City Council initiated enforcement proceedings in the Victorian Civil and Administrative Tribunal (VCAT) in early August 2024 after claims work on the land failed to comply with regulations.

Hume City Council states: “On 19 December Council’s VCAT action was the subject of an administrative mention.

“That mention confirmed that the matter had not yet been resolved and is proceeding to a full hearing listed for 11-13 March 2025.  Council sought no further procedural orders at the mention.” 

A respondent to the proceeding advised VCAT and the council the required Erosion Management Plan (EMP) is being prepared and will be ready for submission in late January 2025.

VCAT advised that a second Administrative Mention will be called in February for that EMP to be discussed in response to VCATs original tribunal order.

Council states that all works on the land have ceased.

An administrative mention is a court date when parties are required to send consent orders or request a directions hearing to the court. It’s not a court hearing, and no appearance is required. However, failure to respond to an administrative mention may result in the proceeding being dismissed.
